Terms and Conditions of Heins Ruht
§ 1 Scope of Application, Definitions
The present terms and conditions apply to the accommodation of employees and guests (hereinafter referred to as “the guest“) of GOLDBECK GmbH and affiliated companies within the meaning of § 15 AktG (GOLDBECK Group), as well as all other services provided to this group of users by Objekt Hochhaus Bielefeld Betriebsgesellschaft mbH (hereinafter referred to as „HEINS“). Other users are considered guests in this sense, provided the booking is made by another company with the consent of Heins and/or the GOLDBECK Group.
§ 2 Booking
Reservations and bookings are made exclusively directly with HEINS, typically via the Heins ruht website or the booking link integrated into the GOLDBECK Travel Management Portal. Alternatively, they may also be made in text form or by phone. A binding booking is concluded upon acceptance of the reservation made by or on behalf of the Guest by Heins via the booking platform Mews or in text form.
The contractual partners are Heins and the Guest. If the booking is made by someone other than the guest, i.e., a third party, the third party, as the ordering party, is jointly and severally liable with the Guest for all obligations arising from the accommodation contract. The subletting or re-letting of the provided room, as well as the use of the room for purposes other than the usual or agreed ones, require prior written consent from HEINS.
Optional reservations (e.g., seminar contingents) for rooms or other services are only binding if an option date or option period is specified. After the option period has expired, HEINS is free to dispose of the rooms and services booked as options.
§ 3 Services, Prices
Heins is obliged to provide the booked rooms and perform other agreed-upon services.
The Guest is obliged to pay the applicable or agreed prices for the room and any additional services utilized.
A price change by Heins may occur if the guest subsequently requests changes to the number of booked rooms, Heins’ services, or the duration of the stay, and HEINS agrees to such changes.
The applicable or agreed prices are quoted net, plus the statutory value-added tax in effect at the time.
§ 4 Payment
Unless otherwise agreed in writing, payment for accommodation and any additional services agreed upon at the time of booking is generally made by the ordering party via invoice and bank transfer.
Invoices from HEINS are payable within 14 days of receipt.
Unless a prepayment has been agreed upon, charges become due upon arrival or at the start of service delivery without deduction.
§ 5 Provision of Rooms
The Guest has no claim to a specific room unless a corresponding confirmation is provided by HEINS in text form.
Booked rooms are available to the guest from 3:00 PM on the day of arrival. An earlier check-in is only possible after prior consultation with HEINS.
Arrival is possible anytime after 3:00 PM. Check-in is usually completed by the guest via [Straiv using their own smartphone]. A personal check-in is possible by arrangement. A personal check-in after 6:00 PM is not possible.
On the agreed departure day, the room must be vacated and handed over to HEINS by no later than 11:00 AM. In the case of late check-out, HEINS is entitled to charge 50% of the full room price for a return after 11:00 AM and 100% of the full room price for a return after 2:00 PM.
§ 6 Cancellation and Early Departure
a) General
For cancellations before arrival and early termination of the stay, the following cancellation deadlines and fees apply.
A no-show by 12:00 AM on the day of arrival will be treated as a cancellation of the entire stay unless a different agreement has been made in text form beforehand. In this case, 100% of the accommodation price for the first night will be charged as a cancellation fee. For subsequent nights, the provisions under subsections b) to d) below apply. There will no longer be a claim to the provision of the room.
In the case of a no-show, the ordering party and the guest are jointly and severally liable.
The „total accommodation price“ is the price confirmed by HEINS for the entire booking period (excluding breakfast services); in the case of early termination, it applies to the remaining booking period.
The guest has the right to prove to HEINS that no or a lesser damage has occurred.
b) Individual Bookings
HEINS grants the guest a right of withdrawal at any time.
Cancellations are free of charge until 6:00 PM on the day of arrival. For cancellations after 6:00 PM, a cancellation fee of 80% of the accommodation price for the first night will be charged.
c) Long-Term Reservations
For bookings of 7 nights or more, it is considered a long-term reservation. The cancellation period is 2 days; for bookings of 14 nights or more, the cancellation period is 4 days. For late cancellations of a long-term reservation, the unused nights up to the end of the cancellation period will be charged at 80% of the accommodation price.
d) Group Reservations of 10 Rooms or More
For cancellations up to 5 days before arrival, the cancellation is free of charge. For cancellations between the 5th and 2nd day before arrival, 50% of the accommodation price for the first night will be charged. For later cancellations up to 6:00 PM on the day of arrival, 80% of the accommodation price for the first night will be charged. After that, the rules for no-shows apply. For partial cancellations of up to 5 rooms, the rules for individual bookings apply. For group reservations of 7 days or more, the rules for long-term reservations apply.
§ 7 Right of Withdrawal by HEINS
HEINS is entitled to withdraw from or terminate the contract for objectively justified reasons. Objectively justified reasons can include, in particular, cases of force majeure, circumstances not attributable to HEINS that make contract fulfillment impossible, as well as when false statements regarding essential facts, such as the identity of the guest or the purpose of the rental, are made, and when HEINS has justified cause to believe that the rental endangers the safety of other guests or the public image of HEINS.
In the case of use of the room differing from the agreement, HEINS is entitled to terminate the contract immediately.
§ 8 Liability of the Guest and the Ordering Party
The Guest and the Ordering Party are jointly and severally liable for the payment of the contractually agreed amount and for any damages caused by them or their visitors or other third parties in the room.
All rooms are non-smoking rooms. If smoking occurs in the room, an increased cleaning fee of at least EUR 150.00 including the applicable VAT of 19% will be charged.
In the case of non-compliance with our fire safety regulations, the guest is fully liable for the costs incurred by HEINS due to the activation of the smoke extraction system or the smoke detectors.
Any damages or defects in the provided room must be reported to the landlord immediately.
A fee of EUR 20.00 will be charged for the loss of the access card. For the opening service outside of reception hours, a fee of EUR 50.00 will be charged. This also applies if the opening service is required because the guest did not follow the access instructions from the booking confirmation.
§ 9 Liability of Heins
HEINS is liable for its obligations under the contract. Claims for damages by the guest are excluded. Exceptions to this include damages arising from the injury to life, body, or health, other damages caused by an intentional or grossly negligent breach of duty by HEINS, and damages resulting from an intentional or negligent violation of HEINS’ main performance obligations.
If disturbances or defects occur in HEINS’ services, Heins will make every effort to rectify the issue upon becoming aware or receiving immediate notification from the guest. The guest is obliged to contribute what is reasonable to resolve the disturbance and minimize potential damage.
The statutory provisions apply to the unlimited liability of Heins.
Heins is not liable for valuables and money brought in by the Guest.
Liability for lost property is excluded.
HEINS undertakes to handle messages, mail, and parcels of the guests with care. However, no storage agreement is formed, and no liability is accepted for loss, delay, or damage. To ensure reliable mail delivery, the Guest is required to provide their room number for any mail correspondence.
§ 10 Internet
The guest can use the internet in the rooms free of charge. HEINS is not liable if network overload prevents an internet connection from being established. The internet may only be used within the limits of what is legally permissible.
§ 11 Final Provisions
Oral agreements only become effective when confirmed by HEINS in text form.
For all contracts, the law of the Federal Republic of Germany exclusively applies. For any disputes arising from or in connection with the contracts, the exclusive jurisdiction is agreed to be Bielefeld. This also applies if the Customer has no general jurisdiction in Germany. The application of the UN Sales Convention and conflict of law is excluded.
The place of performance and fulfillment is Bielefeld.
If individual provisions of these Terms and Conditions are or become invalid or void, the validity of the remaining provisions will not be affected. The parties are obligated to replace the invalid provision with a valid provision that most closely reflects the originally intended economic and legal purpose.
